Terms of service

These terms apply to the use of Hostera: the website hostera.nl and the software restaurants use to manage reservations, conversations and related services.

1. Who we are

Hostera provides this service (hostera.nl). Questions about these terms can be sent via our contact page.

2. Who these terms cover

These terms apply to anyone who uses Hostera: website visitors, restaurants and their staff with an account, and anyone accessing Hostera on a restaurant’s behalf. By using Hostera you agree to these terms. A separate contract or plan prevails where it differs.

3. The service

Hostera helps restaurants with reservations and related communication, for example by phone, chat, widget, confirmations, availability and optional integrations such as Google Calendar. Features may differ by plan. We may improve, extend or change the service. We do not guarantee that every feature is always available or that every conversation or reservation is error-free.

4. Accounts and access

Anyone who creates or manages a restaurant account is responsible for accurate account details, strong credentials, and who gets access (staff and roles). Actions through an account count as that restaurant’s actions, unless you promptly tell us the access was misused. You may not force access to other people’s accounts, data or systems.

5. Your responsibilities

As a restaurant you are responsible for, among other things:

  • Correct opening hours, capacity, house rules, FAQ answers and other settings Hostera uses.
  • Your relationship with guests: reservation terms, no-show policy, allergens, complaints and hospitality legal duties.
  • What your team enters in Hostera (notes, guest data, messages) and whether that is allowed under privacy law.
  • Not misusing the service (spam, deception, infringement, unlawful content, overloading systems).

6. Reservations and guests

Hostera is a tool. A reservation through Hostera is an agreement between the restaurant and the guest. Hostera is not a party to that agreement and is not liable if a table is unavailable, a guest does not show, or the restaurant does not honour a reservation. Group requests or reservations that still need confirmation are only final according to their status in Hostera.

7. Integrations, including Google Calendar

Optional integrations such as Google Calendar are switched on by you. Hostera remains the source of truth: reservations can be sent one way to Google; changes in Google are not written back to Hostera. You choose the Google account and calendar, and you remain bound by Google’s terms. Disconnecting ends the Hostera connection; existing Google events are not deleted automatically. Outages or changes at a third party may interrupt the integration.

8. Availability

We aim for a stable service, but downtime, maintenance, hosting, telephony or third-party outages, and force majeure can occur. We are not obliged to provide uninterrupted availability unless agreed in writing.

9. Intellectual property

Hostera, the software, copy, brands and design remain ours or our licensors’. You receive a limited, non-exclusive right to use the service for your restaurant while your account is active and you comply with these terms. Content you enter (menus, copy, guest data) remains yours or your guests’; you grant us the licence needed to provide the service.

10. Liability

To the extent permitted by law, Hostera is not liable for indirect loss, lost revenue, missed reservations, reputational harm or data loss. Our total liability is limited to the amount the restaurant paid Hostera in the twelve months before the claim, or — if no paid plan applied — to what is reasonable given free or trial use. This limit does not apply in case of intent or wilful recklessness.

11. Termination

You may stop using Hostera by closing your account or, where applicable, ending the integration or plan. We may suspend or end access in case of misuse, non-payment, or if continuing the service cannot reasonably be required of us. After termination, access to the service may end. Data retention is described in our privacy policy.

12. Privacy and cookies

How we process personal data is described in our privacy policy. How we use cookies is described in our cookie policy.

13. Changes

We may update these terms if the service or the law changes. The date at the top of this page shows the latest update. For material changes we will try to inform restaurants. If you keep using the service after that, the new terms apply.

14. Governing law

These terms and the use of Hostera are governed by Dutch law. Disputes are submitted to the competent court in the Netherlands, unless mandatory law requires otherwise.
